It is important to remember you have limited time to finalise your property settlement after separation.
If you were in a de facto relationship you have two years after the date of separation.
If you are divorced you have 12 months after the date of divorce.
If you are still within these time limits but approaching them you should consider commencing proceedings.
If you Commence proceedings it doesn’t mean you will end up fighting in court, it is simply an effective way to protect your financial interest while you negotiate with the other party.
If you do not commence proceedings or come to an agreement within the relevant time frame this complicates your matter but does not mean you are without relief.
You can do either a consent order or a financial agreement out of time, however, this requires the parties to agree which might be difficult once the time has elapsed.
If you are out of time and the parties won’t agree you need to make an application to the court, these can be difficult to succeed in and we recommend you seek the help of an experienced family lawyer.
